Illegal Tenants/Occupants*

Please be aware that any applicants or tenants not disclosed on the application are considered illegal tenants/occupants. Express written permission MUST BE provided by the Landlord during the entire length of the tenancy to add an occupant and/or tenant to the Lease.

Long Term Guests: *

The tenant must request in writing to the Landlord if a guest will be allowed to stay for a period longer than a 7 days with a determined length of the expected stay. This request must be approved or declined by the Landlord. If approved, express written permission must be provided to the tenant by the Landlord for any long term guests that plan to visit for longer than a 7 day period with an agreed upon end date of that visit. Without express written permission from the Landlord, unauthorized occupants/tenants/long term guests are strictly prohibited.

You will be subject to an N5 Notice to Evict if you are in found to be in contravention of Section 67 as per the Residential Tenancies Act as follows:

Termination for cause, too many persons*

67 (1) A landlord may give a tenant notice of termination of the tenancy if the number of persons occupying the rental unit on a continuing basis results in a contravention of health, safety or housing standards required by law. 2006, c. 17, s. 67 (1).

I/We hereby certify the information provided above and on the reverse of this form to be true. I/We agree that upon acceptance of this Rental Application by the Landlord, I/We shall forthwith enter into a Tenancy Agreement incorporating the above terms into the Landlord's tenancy agreement which I/We have been given the opportunity to review, in which even the Contract Deposit shall be deemed to be a Rent Deposit and applied towards the rent of the last month's occupancy. If I/We should fail to enter into such tenancy agreement, in addition to any other right to damages accruing to the Landlord, I/we agree and acknowledge that the contract deposit shall be forfeited.

If the Landlord is unable to give possession of the rented premises on the date of commencement of the term for any reason, the Landlord shall not be subject to any liability to the Applicant's and shall give possession as soon as the Landlord is able to do so. The rent shall abate until possession of rented premises is offered by the Landlord to the Tenant. Failure to give possession on the date of commencement shall not in any way affect the validity of the Tenancy Agreement, the obligations of the tenant or in any way be construed to extend the term of this Tenancy Agreement. In the event that a Tenancy Agreement is entered into, this Rental Application by the terms of clause 27 of the Tenancy Agreement will be deemed to form part of the Tenancy Agreement. Any omission of misstatement by the Applicants in this Rental Application may result in the termination of the tenancy by the Landlord even after occupancy has been taken.

The Applicant hereby gives permission to the Landlord or his Agent to use the information collected herein to obtain a consumer report, to contact employers, previous Landlords, to contact agencies that provide Landlord information, to enforce the terms of any Tenancy Agreement that may be subsequently entered into with the Applicant; or to reasonably use it otherwise to assess this Rental Application. It is agreed that where this Application is rejected, the Landlord shall not be required to give reasons therefore. The Applicant agrees that the following is prohibited on the premises and will not partake in:
Recreational or Medical Marijuana Smoking,
Recreational or Medical Marijuana Retail
Recreational or Medical Marijuana Growing
Recreational or Medical Marijuana Warehousing
